Terms of service

The plain rules for working with us. Your written quote gives the details of your project.

Last updated: October 27, 2026

1. Who we are

Smail Laouchedi, operating as EclipseTone Productions, Montréal, Québec. Email: laouchedismail@gmail.com. Phone and WhatsApp: +1 438 466 8971. Our full mailing address is in every written quote.

2. Your quote is the contract

Before you pay anything, we email you a written quote with what we will make, the price of each item, taxes, the total in Canadian dollars, the expected dates, the stages of the work and these terms. The project starts when you accept the quote in writing and pay the first stage. We email you a copy of the accepted quote and these terms within 15 days.

3. Paying in stages

Prices are in Canadian dollars. Clients in Canada pay GST and QST on top; clients outside Canada don’t. You pay in two stages:

  • Stage 1, half the price, to start. It pays for the arrangement, the musicians and the production up to the first version of the music.
  • Stage 2, the other half, before you get the final files. It pays for the vocal recording, the changes, the mix, the master and the delivery.

We accept the payment methods listed in your quote. Final files are sent once the project is paid in full.

4. Recording your vocals

  • Full Song includes one 2-hour vocal session in our Montréal studio, booked together once you approve the music. Extra studio time is $50 per hour, confirmed before we use it.
  • To move a session, tell us at least 48 hours before. A session missed without notice counts as used.
  • Recording somewhere else? We send you a recording guide, and the cost of that studio is yours. We check your takes before the mix and tell you if anything needs to be recorded again.
  • Your voice memo or demo is a guide for building the music. It is not used as the final vocal unless we both agree in writing.

5. Dates and changes

Dates are estimates. They depend on you sending what we need on time and on your recording date. The first version of the music is usually ready within 7 days of receiving your memo, and a Full Song usually takes 2 to 3 weeks in all. Your package includes a set number of rounds of changes (for example, 2 on the music and 2 on the mix). A round is one list of changes sent together. Extra rounds, or changes to a part you already approved, are priced before we do them, and we only do them if you say yes.

6. If you go quiet

If we don’t hear from you for 60 days after we ask for your feedback, your files or a recording date, we close the project. You pay only for the work done up to then, as set out in section 8. You can reopen it later when a spot is free.

7. Your music and your rights

  • You confirm you own, or have permission to use, everything you send us: lyrics, melodies, vocals, recordings, photos and logos.
  • Once the project is paid in full, the final song, the instrumental we made for it and your vocal recordings are yours, in writing. Until then, we keep the rights to our work.
  • Your songwriting stays yours, 100%, including the lyrics and melodies we help you write in Song + Songwriting. We claim no writing credit or songwriting royalties.
  • Separate instrument tracks and project files aren’t included unless your quote says so.
  • Covers: a song written by someone else needs a licence before you release it. Most distributors arrange it for you. Getting it is your responsibility; we can show you how.
  • Samples: we only use samples that are cleared or that you have the right to use, and we tell you which ones are in your song.
  • We may share the finished work on our channels, credited to EclipseTone for the production. If you’d rather we didn’t, or want us to wait until your release date, tell us in writing.

8. Cancelling and refunds

  • You can cancel at any time. Tell us by WhatsApp or email.
  • Before we start work: we refund everything you paid, within 15 days.
  • After we start: you pay for the work done up to the day you cancel, valued with the stages and prices in your quote, plus any costs we already paid for your project (for example a session musician, studio time or a factory order). We refund the rest within 15 days. Once the first version of the music is delivered, stage 1 is fully earned, and a studio session that has taken place counts as work done.
  • You receive the files made so far once that work is paid.
  • CDs, USB-C cards and cassettes: once you approve the proof and we order them from the factory, the order can’t be cancelled. If they arrive damaged, or with a mistake that wasn’t in the proof you approved, we replace them.
  • Taste isn’t a defect. If the work matches what you approved, we don’t refund it because you changed your mind about the sound; that’s what the rounds of changes are for.
  • If we can’t finish your project, we refund everything you paid for the parts we didn’t deliver.
  • You can also cancel within 7 days of receiving your copy of the contract if it is missing information the law requires, and in the other cases the Consumer Protection Act provides.

9. What we don’t promise

We make your music, video or website with care and to the standard described in your quote. We can’t promise results that depend on others, such as streams, views, followers, playlists, radio play or sales.

10. Your files

We keep your project files for 90 days after delivery. Download and back up everything you receive; after that, we may delete them.

11. Questions or a problem

Write to us first at laouchedismail@gmail.com, and we’ll answer within 5 business days. These terms are governed by the laws of Québec. Nothing in them takes away a right you have under the Consumer Protection Act or the Civil Code of Québec.
